Die Stiftung für Kontinentalrecht unterstützt das Projekt des europäischen Wirtschaftskodex’

Diese Initiative ist ein starkes Engagement zugunsten der Bildung Europas, sowie der Förderung und Konvergenz des Kontinentalrechts auf europäischer Ebene.

Präsentation des europäischen Wirtschaftskodex’

Die Stiftung für Kontinentalrecht unterstützt die Ausarbeitung eines europäischen Wirtschaftskodex’ mit dem Ziel auf europäischer Ebene geltenden wirtschaftsrechtlichen Regeln zu vereinheitlichen. Es geht darum, das Recht in das Zentrum der Bildung Europas zu stellen und der gemeinsamen Währung einen Sinn zu geben, indem man den freien Waren- und Kapitalverkehr durch die Konvergenz des Wirtschaftsrechts der mehrheitlich dem Kontinentalrecht unterliegenden Mitgliedsstaaten fördert und auf diese Weise eine bessere Transparenz und Sicherheit des für die Wirtschaftsakteure geltenden Gesetzesrahmens gewährleistet.

Die Aufspaltung der Kompetenzen zwischen der Union und den Mitgliedsstaaten sowie die Grundsätze der Subsidiarität und der Proportionalität bildeten erhebliche Hindernisse für eine wahrhaftige Integration des Wirtschaftsrechts auf europäischer Ebene. Der Vorschlag eines europäischen Wirtschaftskodex’ geht auf eine Bürgerinitiative zurück, die diesen im Zuge eines von Akademikern und Juristen des Vereins Henri Capitant mit der Unterstützung der Stiftung für Kontinentalrecht erstellten Inventoriums ans Tageslicht gebrachten Mangel beheben sollte (Der Europäische Aufbau im Wirtschaftsrecht: Besitzstand und Perspektiven) mit einem Vorwort des ehemaligen französischen Staatspräsidenten Valéry Giscard d’Estaing.

The Civil Law Initiative (Fondation pour le droit continental) supports the proposal for a European Business Code

This initiative is a strong commitment in favour of European integration, and the promotion and convergence of continental law Europe-wide.

The European Business Code

The Civil Law Initiative supports the drafting of a European Business Code, which is intended to unify business law in the countries of the European Union. The aim is to restore the law to the heart of European integration and give a sense of direction to the single currency, by encouraging the free movement of goods and capital through the convergence of the business laws of the Member States, the immense majority of which are governed by continental law, thereby ensuring greater comprehensibility and greater security for the regulatory framework that applies to the economic actors.

The dispersal of powers between the Union and the Member States, and the principles of subsidiarity and proportionality have been powerful brakes on real integration of business law at European level. The proposed European Business Code is a citizens’ initiative that offers a response to this deficiency, which has been highlighted by the work of the academics and legal practitioners of the Association Henri Capitant, who have reviewed this field with the support of the Civil Law Initiative in their work entitled The integration of European business law: acquis and outlook, which has a Preface by President Valery Giscard d’Estaing.
